Welcome to ZesstBites International Pvt. Ltd. (“ZesstBites “, “we”, “our”, or “us”). These Terms and Conditions (“Terms”) govern your use of our website, mobile applications, ordering systems, loyalty platforms, in-store technologies, and any other services provided directly or indirectly by ZesstBites or its affiliates.

33. Definitions

• User:  Any person using the website, mobile app, or other ZesstBites services.
• Customer:  A User who places an order or purchases any service or product.
• Franchise:  An independent business operating under the ZesstBites brand.
• Vendor: A supplier, service provider, or business partner.
• Platform: Collectively refers to our website, mobile applications, kiosks, digital tools, and communication systems.
• Services: All services offered by ZesstBites including food delivery, dine-in, takeaway, loyalty, and digital content.

34. Eligibility

You must be at least 18 years of age or the legal age of majority in your jurisdiction to access or use our services. If you are accessing the services on behalf of a business or entity, you must have the authority to bind that entity to these Terms.
We reserve the right to deny or terminate access to any user deemed ineligible or in violation of these Terms.

35. User Account Creation and Management

To access certain features, you may need to register and create an account. You agree to:
• Provide accurate, current, and complete information.
• Maintain confidentiality of your login credentials.
• Accept responsibility for all activities under your account.
• Notify us immediately of any unauthorized access or suspicious activity.
ZesstBites reserves the right to suspend or delete accounts that violate terms, contain false information, or engage in malicious activity.

36. Order Placement, Fulfillment, and Delivery

Orders may be placed via our platform, phone, or in-store kiosks. By placing an order, you:
• Confirm the accuracy of items, address, and instructions.
• Agree to pay the total amount as displayed at checkout.
• Accept estimated delivery times which may vary due to location or traffic.
ZesstBites reserves the right to cancel or delay orders due to stock shortages, weather, system errors, or unforeseen events. In such cases, you will be notified and refunded where applicable.

37. Pricing, Payments, and Taxes

All prices listed on our platform are inclusive of applicable taxes unless stated otherwise. ZesstBites reserves the right to update prices without prior notice.

Accepted payment methods include credit/debit cards, digital wallets, net banking, and UPI. Payments must be completed before delivery is initiated.
ZesstBites is not responsible for failed transactions due to network issues or third-party payment gateway failures. If your account is debited but no order is confirmed, please contact support for resolution.

38. Offers, Discounts, and Promotions

Offers and discounts are subject to specific terms and conditions, including validity period, geographic restrictions, and user eligibility.
Promotional codes must be applied at checkout and cannot be exchanged for cash. ZesstBites may reject coupons deemed fraudulent or expired.
We reserve the right to withdraw or modify any promotion without prior notice.

39. Loyalty Program and Points Policy

Our loyalty program awards points based on order value and participation in specific activities. Accumulated points:
• Can be redeemed on future orders,
• May be forfeited upon account closure,
• Are non-transferable and have no monetary value unless specified.
ZesstBites reserves the right to alter or discontinue the program at any time.

40. Product Descriptions, Ingredients, and Allergens

While we strive for accuracy, product descriptions, ingredient listings, and images on our platform may differ slightly from actual items.
Customers with allergies must review product details carefully or contact support before ordering. ZesstBites is not liable for allergic reactions resulting from undisclosed sensitivities.

41. Refunds, Returns, and Cancellation Policy

Refunds are provided only in the following cases:
• Non-fulfillment of prepaid order,
• Wrong or missing items,
• Orders cancelled within the allowed time window.
All refund requests must be made within 24 hours of order receipt. Refunds will be processed within 7 working days via the original mode of payment.
Orders once placed cannot be modified. Cancellation may not be possible if the food is already prepared or dispatched.

42. Use of Website and Mobile Application

Users agree to:
• Access the platform only through authorized means,
• Not interfere with system functionality or attempt unauthorized access,
• Not upload viruses, malware, or illegal content.
ZesstBites may restrict or terminate access at its discretion if abuse or misuse is detected.

All trademarks, logos, graphics, content, and software on our platform are owned or licensed by ZesstBites. Unauthorized use, reproduction, or distribution is strictly prohibited.
Users may download content for personal, non-commercial use only, with all copyright notices intact.

44. Customer Content and Reviews

Users may post reviews or feedback that are:
• Truthful and based on personal experience,
• Non-abusive, non-defamatory, and non-promotional.
By submitting content, you grant ZesstBites a worldwide, royalty-free license to use, modify, and display it for business and marketing purposes.

45. Franchise and Vendor

Transactions
Franchisees and vendors operating under ZesstBites must adhere to separate agreements that include:
• Operational standards,
• Quality control,
• Branding guidelines,
• Payment and dispute resolution terms.
Violations may lead to suspension or termination of the business relationship.

46. Third-party Services and Links

ZesstBites may integrate third-party services such as payment gateways, delivery partners, and analytics tools. We are not liable for issues arising from use of these external services.
Our platform may also contain links to external websites. We do not control and are not responsible for their content or privacy practices.

47. Data Collection, Usage, and Privacy

Your data is collected and used as outlined in our Privacy Policy. We:
• Use secure protocols,
• Do not sell data to advertisers,
• Share it only with partners under strict agreements.
Users can access, modify, or delete their data upon request.

48. IT Security and Unauthorized Access

We maintain strong IT security controls including:
• SSL encryption,
• Intrusion detection,
• Regular audits.
Unauthorized access attempts may be prosecuted under applicable law.

49. Prohibited Activities

Users may not:

Violations may lead to account suspension and legal action.

50. Limitation of Liability

ZesstBites shall not be liable for:

Total liability, if proven, will not exceed the value of the order in question.

51. Indemnification

You agree to indemnify and hold harmless ZesstBites and its affiliates against any losses, claims, damages, or legal expenses arising from:

• Violation of third-party rights.

52. Disclaimer of Warranties

All services are provided “as is” without warranties of any kind. We do not guarantee uninterrupted or error-free access.
We disclaim liability for:
• Errors in pricing or content,
• Compatibility issues,
• Downtime due to maintenance or technical problems.

53. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Hyderabad, India.

54. Dispute Resolution Mechanism

We aim to resolve disputes amicably. Users must first contact our support team. If unresolved, disputes will be settled via arbitration under the Arbitration and Conciliation Act, 1996.
Arbitration will take place in Hyderabad in English, and the award will be binding.

55. Force Majeure

ZesstBites shall not be held responsible for delays or failures due to events beyond our control, such as natural disasters, pandemics, internet outages, strikes, or government actions.

56. Amendments to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or site banner.
Continued use after changes constitutes acceptance.
